1. Agreement to these terms

These Terms of Service (“Terms”) govern your access to and use of the website at sandadiks.com and any related pages, content, products, or services we operate (collectively, the “Site”). The Site is operated by Sand Adiks (“Sand Adiks,” “we,” “us,” or “our”).

By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Site.

2. Who we are

Sand Adiks is a community-rooted brand and online presence associated with the Oregon Coast dune lifestyle — UTVs, sand rails, ATVs, and the people who ride them. The Site may include brand information, community links, merchandise offerings (when available), and related content.

Third-party platforms we link to (including Facebook groups and social channels) are operated by their own providers and are subject to those providers’ terms and policies.

3. Eligibility

You must be able to form a binding contract under applicable law to use the Site. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Use of the Site

You agree to use the Site only for lawful purposes and in a way that does not:

• Violate any applicable law or regulation
• Infringe the rights of Sand Adiks or any third party
• Interfere with or disrupt the Site, servers, or networks
• Attempt to gain unauthorized access to any systems or data
• Scrape, harvest, or systematically collect content without our prior written permission
• Transmit malware, spam, or other harmful or unsolicited material
• Impersonate any person or entity, or misrepresent your affiliation

We may suspend or terminate access to the Site at any time if we reasonably believe you have violated these Terms.

5. Community and third-party platforms

Links to Facebook groups, social media, or other third-party services are provided for convenience and community connection. Your use of those platforms is governed by their terms. We do not control and are not responsible for third-party content, rules, moderation, availability, or privacy practices.

Participation in any community associated with Sand Adiks is expected to be respectful. Harassment, hate, threats, illegal activity, or unsafe encouragement related to riding or other activities may result in removal from community spaces we control, and may be reported to platform operators or authorities where appropriate.

6. Products and merchandise

From time to time we may offer stickers, apparel, or other merchandise through the Site or linked storefronts. Product descriptions, pricing, availability, shipping, returns, and payment terms will be stated at checkout or on the applicable store page. We reserve the right to limit quantities, refuse orders, correct pricing or description errors, and discontinue products without notice.

Colors and product images on the Site may vary from physical goods. Unless required by law, products are offered “as described” at the time of purchase, subject to the return policy then in effect.

7. Intellectual property

The Site and its contents — including text, graphics, logos, wordmarks (including “Sand Adiks” / “SANDADIKS”), images, design, layout, and other materials — are owned by Sand Adiks or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may view and temporarily store pages from the Site for personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from our content or branding without our prior written consent, except as allowed by applicable law.

8. User submissions

If you submit feedback, ideas, photos, messages, or other content to us through the Site or channels we operate (“Submissions”), you grant Sand Adiks a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, publish, and display those Submissions for operating, promoting, and improving our brand and services, subject to our Privacy Policy and any platform rules where the content was originally posted.

You represent that you have the rights needed to grant this license and that your Submissions do not violate any law or third-party rights.

9. Safety disclaimer — riding and outdoor activity

Off-road riding, dune recreation, and related activities involve serious risk of injury or death. Content on the Site (including community posts we may link to) is for general information and brand purposes only. It is not professional safety, legal, mechanical, or medical advice.

You are solely responsible for your equipment, skill, compliance with local laws and land-use rules, personal protective equipment, and decisions about when and how to ride. Sand Adiks is not responsible for injuries, property damage, or other losses arising from your participation in riding or outdoor activities.

10. Disclaimers

THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT CONTENT WILL BE ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SAND ADIKS AND ITS OWNERS, AFFILIATES, AND REPRESENTATIVES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR ANY PRODUCTS OR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US FOR PRODUCTS OR SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Sand Adiks and its owners, affiliates, and representatives from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Site, your Submissions, your violation of these Terms, or your violation of any third-party rights.

13. Links to other sites

The Site may contain links to third-party websites or resources. We are not responsible for the content, products, services, or practices of those third parties. Accessing them is at your own risk.

14. Changes to the Site and these Terms

We may update the Site and these Terms from time to time. When we change these Terms, we will update the “Last updated” date above. Continued use of the Site after changes become effective constitutes acceptance of the revised Terms. If you do not agree, stop using the Site.

15. Governing law

These Terms are governed by the laws of the State of Oregon, United States, without regard to conflict-of-law principles, except where mandatory consumer protection laws in your jurisdiction provide otherwise. You agree that courts located in Oregon will have exclusive jurisdiction over disputes arising from these Terms or the Site, subject to applicable law.

16. General

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right is not a waiver. These Terms, together with the Privacy Policy and any product-specific terms presented at purchase, form the entire agreement between you and Sand Adiks regarding the Site.
